Open Future report on exclusivity clauses in the ODD, and the Google book scanning projects. This text seems to say exclusivity clauses are regulated since the latest incarnation of the ODD, but in fact they have been in place since the very first PSI Directive 2003, and steadily tightened in 2010, 2019, as well as in the DGA.
