for - quote - transnational capitalism escapes the regulation of nation states - Michel Bauwens - climate crisis - transnational capitalism escapes the regulation of nation states - example - COP conferences and climate change quote - transnational capitalism escapes the regulation of nation states - Michel Bauwens (see below) - The nation-state equilibrium started to be disrupted in the 1980s. - Neoliberalism is in fact, also a failed attempt at global regulation. - Several events, such as - the conservative counter-revolution of Thatcher and Reagan, - the collapse of the Soviet Union in 1989-91, and - the failure of the first attempt at democratic coordination of the economy in Chile (Cybersyn), - contributed to the emergence of a new world order in which, for the first time in history, - transnational capital could significantly escape the regulation of the nation-states, rendering the latter inoperative. - This was of course done consciously and with the collaboration of neoliberal nation-states.
comment - This is why climate change agreements at the nation-state level, such as COP conferences, are such dismal failures - Trump was bought out by billionaires who wanted to maintain their status quo money-making-machines - In this sense, this is conservatism at work - Economic, fossil-fuel incumbents teamed up with Christian fundamentalists to make a last valiant attempt at preserving the old order - Unfortunately, if they succeed, it will definitely accelerate their demise as well as the entire biosphere

In Grants Pass v. Johnson, the Supreme Court will decide whether it constitutes cruel and unusual punishment to fine, ticket, or jail someone for sleeping outside on public property if they have nowhere else to go. A ruling in favor of the plaintiffs would make it easier for communities to clear out homeless people’s tent encampments, even if no available housing or shelter exists.

Rupert Read has the best idea I have heard re international climate negotiations: countries that are serious should have their own conference where they collaborate on strong targets, plans, etc. Part of which should be recognising the dangers of remaining reliant on the petrostates, planning to transcend that reliance and sanctioning them
-
for: good idea - COP alternative, COP alternative - coalition of the willing, COP alternative - social tipping point, Rupert Read - alternative to COP
-
good idea: COP alternative
- This could work based on the principle of social tipping points
- The current COP pits the powerful incumbents of the old system delaying as long as possible rapid system change, these are the conservatives
- This puts the liberals at distinct disadvantage from the conservatives because in a consensus reached agreement, the conservatives can veto any strong and binding language that represents rapid system change
- In an alternative conference where the 100+ nation states are already in agreement, action in this smaller coalition OF THE WILLING, will lead to rapid action.
- This could lead to breaking the threshold of system change via reaching the 25% social tipping point threshold
-
question: alternative COP
- If an alternative COP was held, is the nation state the best level to approach?
- What about a city level COP?

Thank you. Steve, for raising the alarm on this catastrophe! One minor comment. It should be QC'ed, not QA'ed. Quality control is done first. Quality Assurance (QA) comes after QC. QA is basically checking the calculations and the test results in the batch records. I worked in QC and QA for big pharma for decades. I tried to warn people in early 2021 that there's no way the quality control testing could be done at warp speed. Nobody listened to me despite my decades of experience in big pharma!
"warp speed" sounds fancy, plus "its an emergency, we have no time"...
it really was just an intelligence test, a global-scale exploit of trust in authorities. (and lets be honest, stupid people deserve to die.)
problem is, they (elites, military, industry) seem to go for actual forced vaccinations, which would be an escalation from psychological warfare to actual warfare against the 95% "useless eaters".
personally, i would prefer if they would globally legalize serial murder and assault rifles, then "we the people" would solve the overpopulation. (because: serial murder is the only alternative to mass murder.) but they are scared that we would also kill the wrong people (their servants because they are evil or stupid). (anyone crying about depopulation should suggest better solutions. denying overpopulation is just another failed intelligence test.)

Much of what they do can be done without eliciting the ire of nation-states. Bike shares, pedestrian zones, insulated buildings, renovated port facilities, congestion fees, car emission limits, furnace specifications, fuel upgrades (from oil to gas to alternative energy) and white paint roofs, for example, are only some of the innovations city officials can promote to effect significant reductions in emissions and pollutants.

here states have grown dysfunctional and sovereignty has become an obstacle to global democratic action—as when the United States (or China, France, or Canada) refuses to compromise its sovereignty by permitting the international monitoring of carbon emissions on its soil—cities have increasingly proven themselves capable of deliberative democratic action on behalf of sustainability, as they have actually done in intercity associations like the C-40 or ICLEI. If presidents and prime ministers cannot summon the will to work for a sustainable planet, mayors can. If citizens of the province and nation think ideologically and divisively, neighbors and citizens of the towns and cities think publicly and cooperatively.
!- claim : cities can mitigate corrupted democracy and foster global cooperation - ie. C40 or ICLEI (also Covenant of Mayors) - cities are not plagued by the problems of state actors who cannot reach any meaningful agreement at COP conferences

In the United States, for example, the Copyright Office has declared that it will “register an original work of authorship, provided that the work was created by a human being.” This stance flows from case law (e.g. Feist Publications v Rural Telephone Service Company, Inc. 499 U.S. 340 (1991)) which specifies that copyright law only protects “the fruits of intellectual labor” that “are founded in the creative powers of the mind.” Similarly, in a recent Australian case (Acohs Pty Ltd v Ucorp Pty Ltd), a court declared that a work generated with the intervention of a computer could not be protected by copyright because it was not produced by a human.

what happens um when we're thinking about our inner states one of the things that we need to recognize is that our introspection when 00:22:54 we we become aware of our beliefs our desires and our hopes and our fears and so forth is all done through language and on the model of language when i decide that i believe that john dunn 00:23:07 gave a great talk this morning when i believe that hal roth is a great scholar of zen and when i believe that alan wallace gave us a beautifully inspirational talk about the role of practice and contemplation in the 00:23:19 understanding of the self and i introspect that way i'm using those sentences alan gave that great talk john gave us a great talk about pramana and so forth as models for my inner states and i'm not 00:23:32 doing that because i looked inside and saw little english sentences in my brain i'm looking i'm doing that by using language as a kind of introspective model that's a matter of self-interpretation 00:23:44 it's easy to forget that because it feels so immediate so language gives us the concepts that we use to think about the world but it is also the model for the concepts of our propositional attitudes like belief 00:23:58 desire knowledge and so forth and as a model we have to recognize that the model the map isn't the reality to go back to what john uh reminded us of he reminded us of earlier introspection in 00:24:11 terms of language gives us an interpretation it doesn't give us an independent reality that is being interpreted and when we think about the madhyamaka 00:24:23 of nagarjuna and chandrakiri we remember that to be empty is to be empty of any intrinsic nature and if we follow chandra charity as i suggested earlier that means that it is to exist only 00:24:37 dependent on conceptual imputation and what i am suggesting now is that all of our inner cognitive states that we introspect we encounter only through a conceptual imputation only through 00:24:50 interpretation only through language and that is they exist conventionally not intrinsically even though they might appear to us to exist just as we see 00:25:02 them and to do so intrinsically
Another key point:
Language is the tool we use for introspection and as Nagarjuna and Chandrakirti hold, are empty of intrinsic nature. All inner cognitive states that we introspect are attained only through linguistic conceptual imputation so can only exist conventionally and not intrinsically.
This underscores the importance of the symbolosphere, of symbols and language.

Asked in a 2013 C-SPAN interview which presidents he admired, he cited Gerald R. Ford, a Republican who took office in 1974 in the wake of the Watergate scandal. Ford, he said, was “the most emotionally healthy.”“Not that the others were basket cases,” he said, but “they get that bug, and as the late and very great Mo Udall, who sought that office, once put it, the only known cure for the presidential virus is embalming fluid.”

22. We may note in passing the archaic nature of the US Supreme Court, whosejudges are named for life like the pope of the Catholic Church and the apostles of theMormon church. However, a pontifical bull of 1970 denied cardinals over eighty yearsold the right to vote in papal elections, which proves that all institutions can be re-formed, even the most venerable ones.

Alito relies on sources such as Hale without acknowledging their entanglement with legalized male supremacy. The men who cited Hale as they constructed the early American legal order refused to give women the right to vote or to otherwise enjoy full citizenship. Relying on that history of injustice as a reason to deny modern women control over their own lives is a terrible argument but apparently the best Alito can do.
Relying on a history of injustice to continue to deny justice to any person is a predatory argument.

On examination, you will find this very judiciary oppressively constructed; your jury trial destroyed, and the judges dependent on Congress.
Gerrymandering has provided exactly the idea of "judges dependent on Congress" just as Patrick Henry suggested, though it has been done more circuitously than he imagined.

The justices held their final arguments of the current term on Wednesday. The court has set a series of sessions over the next two months to release rulings in its still-unresolved cases, including the Mississippi abortion case.
It's very likely that the decision on Dobbs v. Jackson Women’s Health Organization would have been released late in the typical cycle. The leak of this document prior to the midterm elections may have some profound effects on the election cycle.
-
Alito’s draft opinion includes, in small type, a list of about two pages’ worth of decisions in which the justices overruled prior precedents – in many instances reaching results praised by liberals.
-
Alito approvingly quotes a broad range of critics of the Roe decision. He also points to liberal icons such as the late Justice Ruth Bader Ginsburg and Harvard Law Professor Laurence Tribe, who at certain points in their careers took issue with the reasoning in Roe or its impact on the political process.
But didn't they also criticize the original decision because they felt that there were better and stronger arguments in favor of maintaining the right?
-
No draft decision in the modern history of the court has been disclosed publicly while a case was still pending.

Member States
Perhaps this should be addressed not just to Members States, but, more explicitly to educational stakeholders. In many cases, for example the UK (2022), the "Member State" does not really have the means or the disposition to take seriously any of these recommendations. It is down to institutions and professionals within the territory of the Member State to take the lead, and therefore they are the ones to whom this recommendation should be addressed to.

insidious declamations should have no effect upon the wise legislators who have decreed liberty to humanity. The attacks the colonists propose against this liberty must be feared all the more insofar as they hide their detestable projects under the veil of patriotism. We know that illusory and specious descriptions have been made to you of the renewal of terrible violence. Already, perfidious emissaries have crept among us to foment destruction at the hands ofliberticides. They will not succeed, this 1 swear by all that is most sacred in liberty. My attachment to France, the gratitude that all the blacks conserve for her, make it my duty to hide from you neither the plans being fomented nor the oath that we renew to bury ourselves beneath the ruins of a country revived by liberty rather than suffer the return of slavery.
Here Toussaint states that he refuses to let Vaublanc convince 'property' owners in St. Domingue to regress back to the use of enslavement. Toussaint also says that it he and other Blacks have gratitude to France and will not try to hide the fact they will all fight should, the "enemy of liberty" slavery return.

From 1787 to 1788, Americans would write and ratify a new Constitution that, in a concession to Lower South planters who demanded access to the trans-Atlantic trade, forbade a ban on the foreign slave trade for at least the next 20 years. But Congress could — and, in 1794, did — prohibit American ships from participating. In 1807, right on schedule, Congress passed — and President Thomas Jefferson, a slave-owning Virginian, signed — a measure to abolish the importation of enslaved Africans to the United States, effective Jan. 1, 1808.
As a concession to the south, the Constitution provided a 20 year clause before allowing a ban on the foreign slave trade. In 1807, Congress passed a measure to abolish the importation of enslaved Africans to the united states, which went into effect on January 1, 1808. Of course this didn't stop illegal trade which continued until at least the start of the Civil War.
